Passenger Claims

A passenger is usually never at fault in an accident and in Nebraska, may be able to pursue a claim against the driver who was at fault. With the exception of certain family members and depending on your particular case, you may be able to recover for your property damage, your medical and hospital costs, your pain and suffering, your loss of wages and lost earnings capacity, along with other damages that may arise.

Automobile accidents are by far the majority of cases handled by Dyer Law office, and we have successfully represented the rights of many passenger victims. If the other driver was at fault and leaves the scene of the accident in which you were injured, you may be able to proceed with a claim against the insurance of the car you are traveling in and your own insurance company, depending on those insurance policy provisions. Nebraska law requires that motorists have uninsured and underinsured motorist coverage unless they have signed a separate form rejecting that coverage. In most cases, claims are negotiated with insurance companies and are favorably settled by Dyer Law office, with the client's approval and consent, without you having to go to court.

Remember that insurance companies have professional adjusters and attorneys working to represent their interests and to save the insurance company money. Make sure that you are not dealing with the insurance company at an unfair advantage.
