Medical Bills
In Nebraska, the driver who is at fault and negligent in an accident is responsible for paying, among other things, all medical bills associated with the injuries that driver had caused. Most insurance policies in Nebraska include a provision for payment of some medical expenses regardless of who was at fault so that if someone else is at fault, you can still have your own insurance company pay your bills up to the limits of your medical payment coverage.
Automobile accidents are by far the majority of cases handled by Dyer Law office, and we have successfully represented the rights of many accident victims by not only recovering medical bills, but also for pain and suffering. If medical payments are made by your own automobile or health insurance, that company may be required to be paid back when the case is completed under what is known as a right of subrogation.
If you are the victim of another driver's negligence, you may be able to pursue a claim against the driver who was at fault. In the case where the negligent driver has no insurance or not enough insurance, then it may be possible to pursue a claim against your own personal automobile insurance or the automobile insurance of a member of your household, depending on those insurance policy provisions. You may be able to recover for your property damage, your medical and hospital costs, your pain and suffering, your loss of wages and lost earnings capacity, along with other damages that may arise.
Remember that insurance companies have professional adjusters and attorneys working to represent their interests and to save the insurance company money. Make sure that you are not dealing with the insurance company at an unfair advantage.
